Order No. (70) of 2007 Respecting System of Consulting with the Public and Concerned Authorities

The Chairman of the Board of Directors of the Labour Market Regulatory Authority:

Having pursued Act No. (19) of 2006 with Regard to the Labour Market Regulation, and in particular Article (5/B) thereof;
Legislative Decree No. (75) of 2006 With Regard to the Formation of the Board of Directors of the Labour Market Regulatory Authority; and
After Obtaining consent of the Board of Directors of the Labour Market Regulatory Authority; and
Upon submission by the Deputy Chief Executive Officer, in his capacity as Acting Chief Executive Officer of the Labour Market Regulatory Authority

Orders as follows:

Article (1)

In applying the provisions of this Order and unless the context otherwise requires, the following words and phrases shall have the corresponding meanings:

Authority: The Labour Market Regulatory Authority.

Board of Directors: The Board of Directors of the Authority.

Public Relations Directorate: The Public Relations Directorate of the Authority.

Concerned Authorities: The public or private entities which are concerned with the policies of the labour market.

Subject of Consulting: Projects of rules, regulations and orders that the Authority intends to issue or the measures that the Authority intends to take, whenever such decisions have a tangible effect on the labour market policies.

Consulting: Seeking and exploring the opinion of public and the concerned authorities in order to obtain their views and suggestions in respect of the subject of consulting.

Article (2)

a.The Authority should conduct enough consulting in order to be able to obtain and be aware of the views and suggestions of the public and the concerned authorities , about the subject of consulting.

b.The time span that the Authority chooses to run the consulting should be reasonable, during which the mass and the concerned authorities need to be able to express their views and suggestions in this respect.

c.The Authority should provide a one-point information location through which it could seek the views and suggestion of public and the concerned authorities with regard to the subject of consulting.

Article (3)

The Authority begins to conduct the Consulting process together with setting a mechanism as how to receive the public and the concerned authorities views and suggestions, through some or all of the following means:

  1. Visible or audible medias.
  2. Daily widespread issued daily newspapers.
  3. The website of the Authority and via internet.
  4. Written notifications that contain the details of consulting subject addressed to the concerned authorities.
  5. Questionnaires and polls.
  6. Seminars, conferences and workshops.

Such consulting also may be conducted by an Order from the Chief Executive Officer of the Authority, through any other media that would ensure the obtainment of views and suggestions of the public and would accomplish the necessary transparency in this respect.

Article (4)

Consulting shall be conducted in Arabic language, and it may be accompanied with a translation to a foreign language as and when needed.

Article (5)

The Authority shall provide online the details of the consulting in progress in such a way that it would ensure all people can look at the various views and suggestions, in respect of the subject of consulting.

Article (6)

The public and the concerned authorities are to take into consideration the following points:

  1. Their expressed views and suggestions must be confined to the subject of consulting.
  2. The views and suggestions must be in writing and may be written by one of the Authority’s employees.
  3. The views and suggestions to be submitted to the Public Relations Directorate during the period specified for conducting the consulting.

Article (7)

The Chief Executive Officer of the Authority shall prepare a report comprising a summary of the consulting that took place and the achieved results of the suggested recommendations in this respect. Such report shall be submitted to the Board of Directors of the Authority within two weeks from the date of ending the consulting process; in order for the Board of Directors to take appropriate actions in respect of the subject of the consulting.

Article (8)

The Chief Executive Officer of the Authority shall implement this Order, and shall be published it in the Official Gazette and shall come into force on the next of day of its publishing.
